Response to the Ministry of Health

MinutasCOFEPRIS_IT

1. The document entitled "MinutasCOFEPRIS_IT" documents the agreements reached between the representatives of the MoH and of the tobacco companies during one of the sessions in which the agreement was negotiated. In it, in the fifth page from the top (these pdf files are tricky, so please be patient in finding it. I usually have to start in the very first page and then go down using the keyboard arrows... if I attempt any other way of finding it, I loose the part of the text that is most relevant) you will find a section entitled "5. Publicidad o promici��alsa, equivoca u enga��". There, the agreement is that cigarrette packs will contain a legend stating that "to date there exists no cigarrette that is safe or that marks a difference in the risk to health". It then explicitly states that this label would "leave without effect the intent of the FCTC in it's article 11.1.a)". The label that was apporved in the end differs slightly form the text contained in this document, but is close enough to evidence that a) the objective of the MoH-Big Tobacco agreement was to trump the FCTC and b) that the MoH representatives were clearly aware of that fact.

2. The document labeled "diconsaTabaco.doc" shows that tobacco is sold through the government store system aimed at subsidizing the poorest sectors of society (DICONSA). Furthermore, it shows that tobacco sold there was also subsidized. For instance, a packet of Marlboros costs about 20 pesos anywhere in Mexico. At DICONSA stores it sells for 13 pesos or so. It is important to remark that DICONSA is not a dependency of the MoH, but it is surprising to see that the MoH did nothing about that subsidy for years (that I know of, they haven't done anything, but they might have since then, for the information was leaked to the press at some point and there was a bit of a scandal).

3. The document entitled "WHO-Vera da Costa.pdf" shows that the WHO refused to take on the issue of the MoH-Big Tobacco agreement even though it was alerted about the situation by a healthprofesional working in Mexico.

The documente entitled "ACTA Respuesta SSA.jpg" contains a response from the MoH to a letter written by an anti-tobacco organization and adressed to Frenk, calling hisattention to the problem of the MoH-Big Tobacco agreement. The original letter is contained in the document named "Carta envaida ACTA".

5. (two documents) The document named "EgresosFideicomiso" contains the details of how the money that the MoH got from Big Tobacco has been distributed (up until 2005). The document named "AportacionesFondoTabaco" relates the amounts that the MoH hadreceived from Big Tobacco until 2005.

6. The document named "060126 Minimiza Ssa crcas al convenio con tabacaleras.pdf" is a news paper article in which Frenk is quoted saying "Yes, and what is wrong with that?" when accused of "negotiating with the enemy".

7. The document named "Justifican pacto Frenk310505" contains an interview in which Frenk defends the MoH-Big Tobacco agreement.

8. (two documents). In case you don't already have them, the documents named "Convenio Tabacaleras" and "PrimerConvenio" contain the two agreements subscribed between the MoH and Big Tabacco under Frenk. The one named "Convenio Tabacaleras" is the more recent and the more problematic.

 

9. Last, but not least, is the document that states the expenditures of the MoH on the supposedly anti-tobacco advertising they have undertaken through a publicity campaign called "El paraiso de los fumadores", that is "Smoker's Paradise". Far from preventing tobacco, this campaign seems carefully geared towards promoting tobacco use. For one, it depicts people in the act of (happily) smoking: advertising which, for tobacco companies, is prohibited by law in Mexico. Thus, the MoH is actually doing the work for Big Tobacco that Big Tobacco is legally barred from doing itself. Please look at and listen to the samples of this "anti-smoking" campaign payed for by the MoH which is visible atwww.salud.gob.mx (go to the column on the extreme right to where it says "Otros temas". Right below "Otros temas" there is a link called "Campa ontra el tabaquismo". There you will find the audio a video clips of the "Paraiso de los Fumadores" campaign.
